Yes, but, at no time did we discuss whether attorneys fees were part of the deal and who was responsible for them if one of us turns out to be a thief. That is why I need written contracts from you guys to demonstrate that it is common and understood practice in the dog show/breeding world that if someone doesn't adhere to a contract, they are responsible for court costs and attorneys fees as well as actual damages

A verbal contract is every bit as binding as written as I have found out when I took a client to Court for not showing up at a Training Seminar I was putting on in another business I own.

He had not even sent me the deposit I required and gave me a sob story; I went to the city we were to train in, had booked the training room plus our Guest Room and sure enough - he did not show up.

I took him to small Claims Court and he appeared and was scoffing and told me when this one was over, he would file a suit against me for all of his costs etc.

Well the Judge listened to the stories from us both and he told the judge I was an idiot for showing up at the training when he did not send the required deposit.

The Judge said that had nothing at all to do =with the fact that "we" had a verbal contract.  He argued with the Judge that a verbal was 'here-say' and of no value.

So he had to cough up $3500.00 plus my expenses to get to the city to attend court, etc so owed me $4500.00!

As we were walking out, the guy comes up to me all meek and mild and asked me if he could pay it such and such (the Judge had given him 21 days) - he needed longer.  So I agreed to 3 payments, and he sent them all on time.

Carry on with your suit.  These cheating people have to be taught they cannot mess about with other people's hearts and lives in this manner.

I am claiming, since the one things we DIDN'T have was a written contract, that there are certain understandings within the dog show communities and attorney's fees when someone welshes on a deal that it is accepted practice to sue for not only losses but attorney's and court costs. Since we had no written contract, but a verbal one, the argument must be that this is common practice and it is reasonable to assume all parties who work within this community know and understand that.

 

Any copies of your contracts would helps. Please, if you have the time, highlight the relevant sections. I know that is asking a lot but it saves me the time reading each contract to find the section. which would only take about 10 minutes. But, with maybe 20 contracts…..
