I am so sorry to hear of your misfortune Karon.
It appears a Breeder can set their own rules and it is tough to make any
changes.
However, even if her policy is no refunds - as most Breeders are - the "no
refund" is not valid if something happens to the puppy before you get it!
that is ludicrous.
ONLY If *you *had simply changed your mind after having reserved the puppy
(via deposit) then yes, that is pretty much policy for most breeders. But
even then, there are for sure special considerations.
For example, hearing of your physical misfortune, I can't believe any
breeder would withhold the money if you were unable to take the pup because
of your health issues although some may insist of pr0of. there are
unscrupulous buyers out there as well as breeders.
For the most part, I cannot imagine why any breeder would not refund your
money under the circumstances of what happened to the pup.
Were you interested in leaving your deposit and take a puppy from the next
litter when you will have hopefully, recovered?
That would be what I would ask a buyer to do, but if they still did not
feel comfortable, I would never hold them to the contract
The main reason being that if the buyer were angry and upset about the
initial incident and then 'forced' to take a different puppy, they may take
some of their bad feelings out on the little one. Not most - just some.
good and bad in every situation.
And you should have been made aware of that clause - was it not within
their written Contract?
I always explain to people that our policy is a deposit is suggested but
not required - and if they choose to leave one, it is NOT refundable unless
. . . and I list a few things.
The deposit is basically to assure you, the Buyer, WILL get a puppy from
the litter you choose but it is also so that the Breeder is not 'caught'
holding puppies just on word alone, and then the buyer never shows up --
and sometimes cannot be contacted.
There isn't a LOT you can do other than notify the kennel club (AKC) if you
are in the United States, and IF she registers her dogs. She will get a
black mark on her file.( after they investigate).
If they do not investigate it will be a notification on her file and then
if there are more incidents that people report she could lose her right to
Register anymore dogs.
OR you can take her to what we call in Canada "Small Claims Court".
It is simple to do and you can add other charges, but I am not in a
position to advise you as I am sure US and Canadian courts are somewhat
different.
Extra charges could possibly include emotional stress at the loss of the
puppy, any costs such as gas and or paper work you incur, perhaps the cost
to locate another puppy - check it out.
She definitely would be ordered to at a minimum, refund your deposit.
